Ontario Immigrant Nominee Program (OINP)

 

Overview

The Ontario Immigrant Nominee Program (hereinafter referred to as “OINP”) is the province’s economic immigration program. Foreign workers, international students and others with the right skills, experience and education apply to the OINP for a nomination.

 

The OINP recognises and nominates people for permanent residence who have the skills and experience the Ontario economy needs, and the Government of Canada makes the final decision to approve applications for permanent residence.

Applicants can choose a feasible plan from the following 2 categories according to their situations:

A. International Student Stream

Eligibility:

  • Obtain a full-time job offer, the occupation must be one of 0, A or B positions in the Canadian National Occupation Classification (NOC)
  • Meet the low wages of this occupation and region in Ontario
  • Obtain a degree or diploma issued by a qualified Canadian educational institution
  • Submit the application within 2 years from the date of completion of the degree or diploma
  • Have legal status in Canada (i.e. study permit, work permit, visitor record)

In addition, employers in Ontario must also meet the following criteria:

  • The company has been in operation for more than 3 years
  • The address where the applicant will work must be in Ontario
  • The company complies with Ontario Employment Standards Act and Occupational Health and Safety Act
  • If the applicant is working in the Greater Toronto Area (GTA), the employer must:
    • The total annual income of the most recent fiscal year is at least CAD 1 million
    • There are 5 full-time employees in the workplace, and they are Canadian citizens or permanent residents
  • If the applicant is working outside the Greater Toronto Area (GTA), the employer must:
    • The total annual income of the most recent fiscal year is at least CAD 500,000
    • There are 3 full-time employees in the workplace, and they are Canadian citizens or permanent residents

 

In addition, Employers in Ontario must also meet the following criteria:

 

  • General requirements
    • have been in active business for at least three years prior to submitting your application
    • have business premises in Ontario where you will work
    • have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act

 

  • Revenue requirements
    • a minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions) or
    • a minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the Greater Toronto Area

 

  • Full-time employee requirements
    • at least five full-time employees who are Canadian citizens or permanent residents who work at the location where you will work, or will report to work, if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions) or
    • at least three full-time employees who are Canadian citizens or permanent residents who work at the location where you will work, or will report to work, if you will work or report to work at a location outside the Greater Toronto Area

 

  • Employer Form
    • Your employer must make an application for approval of an employment position by filling out and signing an Employer Form.
    • Your employer then must give you the form so you can scan and upload it with your application.

 

Program Highlights of OINP – International Student Stream:

  1. No language score required
  2. No work experience required
  3. Greatly reduce the burden on employers
  4. Only need to reach the minimum salary of the profession
  5. The work permit can be extended for up to 2 years after obtaining the provincial nomination

B. Foreign Worker Stream

 

The basic requirements of the applicant:

  1. Expression of interest and invitation to apply
  2. Work experience or licence or other authorization
  3. Valid licence or other authorization (if applicable)
  4. Intention to live in Ontario
  5. Legal status in Canada (if applicable)

 

In addition, jobs in Ontario must also meet the following criteria:

  • The job offer must be for a full-time and permanent position. Full-time means the job must be a minimum of 1,560 hours a year and a minimum of 30 hours of paid work per week.
  • The job offered must be in a skilled occupation at Skill Type 0 or Skill Levels A or B of the National Occupational Classification (NOC).
  • The pay of the job offered must meet or be higher than the median wage level, for that occupation, in the specific region of Ontario where you will be working.
  • The position offered must be urgently necessary to your employer’s business. This means that the job offer must align with your employer’s existing business activities and the position must be urgently needed to maintain or grow ongoing business activity.
  • The work you do while in the position of the job offer must occur primarily in Ontario.

 

In addition, Employers in Ontario must also meet the following criteria:

General requirements

  • Have been in active business for at least three years prior to submitting your application
  • have business premises in Ontario where you will work
  • Have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act
  • Demonstrate that enough effort was made to recruit a Canadian citizen or a permanent resident prior to offering the position to you (this only applies if you are currently living outside Canada or working outside of Ontario)

 

Revenue requirements

    • a minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions) or
    • a minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the Greater Toronto Area

Full-time employee requirements

      • at least five full-time employees who are Canadian citizens or permanent residents who work at the location where you will work, or will report to work, if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions)

Processing Times  

Under normal circumstances, an applicant can obtain the visa within 3 years and become a permanent resident of Canada.
